Rights of Jap Citizen to Be Tested in Court

SAN FRANCISCO, June 5. -- (AP) -- The first court test of citizenship rights of Japanese-Americans probably will be provided by the case of Fred Toyosaburo Korematsu, 24-year-old Oakland-born Jauanese [Japanese], accused of violating curfew regulations and failing to evacuate a restricted area.

Korematsu, who is held by federal authorities for grand jury action, will be provided legal assistance by the Civil Liberties Union.

Ernest Besig, Northern California director of the Civil Liberties Union, said his group also had decided to offer assistance to two other Bay District Japanese, and was handling similar cases in Los Angeles and Seattle, but he declared the Korematsu case probably would be used as test litigation.
