READY FOR JAP SCHOOL SUIT

Administration Prefers to Make Statement Regarding Position of Government, With Reasons, From Washington.

Action to Be Instituted in San Francisco This Week -- District Attorney Devlin Returns From National Capital.

SAN FRANCISCO, Wednesday, Jan. 16. -- United States District Attorney Devlin, who was called East to consult with Attorney-General Bonaparte and President Roosevelt with reference to the San Francisco school matter, returned from Washington last night.

When in Washington he assisted the federal law department in the preparation of papers for the test case of the United States against the San Francisco board of education, involving the question of the alleged violation of the treaty with Japan in the segregation of Japanese pupils in the schools of this city.

"The suit will begin this week," said Devlin. "In talking over the matter with Attorney-General Bonaparte I was instructed that he desired, when the suit was filed, to give out the statement of the government's action and the reasons for it, from Washington. I found the administration earnest in its determination to push the question through the courts to a decision."

Devlin said that his preference was to begin action to test the segregation order in the state courts, carrying it thence to the federal courts.
