COLOR BAR IN OWNERSHIP OF REALTY VOTED

Court Rules Landholder Has Right to Restrict Occupancy to White Race.

DENVER, Tuesday, June 17. -- A property owner has the right to include in a deed a provision restricting ownership or occupancy of land to members of the white race, the Colorado State Supreme Court held yesterday.

The court found Lemuel V. Chandler, a real estate dealer, liable for damages for not fulfilling representations made to Edward K. Zeigler and Mabel Zeigler that only whites would be permitted to live in the subdivision where they bought a lot.

After the Zeigler family acquired the lot a Japanese bought and occupied the adjoining lot.

Zeigler and his wife brought suit in Jefferson County court against Chandler, claiming he represented that only whites would live in the district. They were awarded $400 damages and Chandler appealed to the State Supreme Court.
