Alien Land Law To Be Passed Upon Soon

Federal constitutionality of the alien land law passed by the last Washington Legislature is to be passed upon by three United States judges sitting at Tacoma this afternoon. The hearing is expected to last several days.

The case which brought the law before a federal tribunal was the suit filed in the federal district court at Tacoma June 13 by Frank Terrace and wife of White River Valley against L.L. Thompson, state attorney-general, and the state of Washington, the complainants charging that the law is unconstitutional and violates the treaty between the United States and Japan. Terrace and his wife are owners of farm land in the White River Valley which is under lease to Japanese. Representing them as counsel is E.H. Guie, who as speaker of the House of Representatives opposed passage of the law in the Legislature.

The judges sitting en banc are E.E. Cushman of Tacoma, Jeremiah Neterer of Seattle and W.B. Gilbert of San Francisco, members of the United States Circuit Court of Appeals.
